Halle Berry's ex files restraining order after accusing Oscar winner of 'choking' 12-year-old son

Halle Berry is being accused of choking her 12-year-old son by her ex, Olivier Martinez - and the Hollywood actress has fired back.

The 60-year-old French actor and the 60-year-old American actress share a son, Maceo, whom they coparent following their split in 2015. TMZ first reported that Martinez filed a restraining order against Halle for allegedly physically abusing their child on September 26.

According to court documents, Berry was accused of jumping on Maceo and putting her hands around his neck, subsequently choking him last Saturday. Martinez claimed that Berry's fiancé, Van Hunt, was there during the incident. Berry confirmed her engagement to Hunt in February 2026; the two have been together for six years.

The Oscar winner's attorney, Marina Beck, responded to the restraining order and the allegations made against her by her ex-husband.

Berry's attorney said to TMZ, "To say this filing is entirely meritless and deliberately misleading would be an understatement. There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry's minor son Maceo - misconduct for which Mr. Martinez has already been legally sanctioned."

The court documents, obtained by Page Six, Martinez said the alleged incident began an argument between Halle and Maceo, when the Catwoman star told the boy he looks "so stupid" and is "such an idiot" for playing a game with his virtual reality goggles.

"The situation escalated and Petitioner jumped on our son and started physically fighting with him," The Un, deux, trois, soleil star alleged in the court docs. "She grabbed Maceo by the neck and started choking him while shouting, 'Who is dominant now?! Who is dominant?!,'" Martinez claimed.

Martinez said that Maceo called him in panic to come get him after the alleged incident with his mother and told his father he didn't want to go back to her home because he is "traumatized."

Martinez also alleged that Berry has been abusive toward Maceo more than once. "Throughout the last year and a half, Ms Berry had wrestled Maceo to the ground and forced him to 'tap out," he claimed in the court docs.

He claimed that Berry has caused their son mental and emotional distress from racially-charged statements she has made towards him.

Martinez brought up an alleged moment in 2025, when Berry told Maceo that his father is "a white b---- trying to rob a black woman," referring to their child support issues.

"Ms. Berry then asked our son, 'How do you feel about that as a Black man?'” Martinez alleged.

After their eight-year contentious legal battle—where they finalized their divorce following their break-up in 2025—the two agreed on joint legal custody and that Berry would pay Martinez $8,000 a month in child support, per PEOPLE.

The former beauty pageant winner was required to pay him "4.3% of any income she receives above $2,000,000" in additional support.

Martinez further claimed that he has "significant concerns" about Berry’s mental health,“ as well as her alcohol abuse, which I believe have contributed to her abusive conduct.”

Along with the restraining order filed for him and Maceo, Martinez is requesting sole custody of the tween.

The Mirror US reached out to Halle Berry's representatives for comment.
